1. These Rules establish a list of forwarding documents, the procedure for providing and quality requirements for freight forwarding services.

2. The relationship between the forwarder and the client is regulated by the Federal Law “On Freight Forwarding Activities”, these Rules and the freight forwarding agreement.

Relations between the forwarder and carriers on various types of transport are regulated by the Civil Code of the Russian Federation, transport charters and codes.

3. These Rules do not apply to transport and forwarding services in the field of postal services.

4. The terms used in these Rules mean the following:

“forwarding services” - services for organizing the transportation of cargo, concluding contracts for the carriage of cargo, ensuring the sending and receiving of cargo, as well as other services related to the transportation of cargo;

"forwarder" - a person who performs or organizes the performance of freight forwarding services specified in a transport expedition agreement;

“client” - a person who has entered into a transport expedition agreement with the freight forwarder and has accepted the obligation to pay for the transport and forwarding services provided by the freight forwarder;

“transport forwarding agreement” is a civil transaction, according to which one party (the forwarder), for a fee, undertakes an obligation on behalf and at the expense of the other party (the client) to provide transport and forwarding services;

“cargo” - any property in respect of which the forwarder organizes transportation in accordance with the transport expedition agreement;

"shipper" - the person who presented the cargo for transportation;

"consignee" - a person authorized to accept cargo from the forwarder after completion of transportation;

"carrier" - a person transporting goods on the basis of a contract of carriage.

5. Forwarding documents are:

instructions to the freight forwarder (determines the list and conditions for the freight forwarder to provide freight forwarding services to the client under the freight forwarding agreement);

forwarding receipt (confirms the fact that the forwarding agent has received cargo for transportation from the client or from the shipper indicated by him);

warehouse receipt (confirms the fact that the forwarder accepted the cargo from the client for warehousing).

6. Depending on the nature of freight forwarding services, including when transporting cargo internationally, the parties to the freight forwarding agreement may determine the possibility of using forwarding documents not specified in paragraph 5 of these Rules.

7. Forwarding documents are an integral part of the transport expedition agreement.

Forwarding documents are drawn up in writing. The procedure for registration and forms of forwarding documents are approved by the Ministry of Transport of the Russian Federation.

8. To provide transport and forwarding services, the client issues a completed and signed order to the forwarder. The order to the forwarder, drawn up in the established manner, must contain reliable and complete data on the nature of the cargo, its markings, weight, volume, as well as the number of packages.

The order to the forwarder is submitted to him by the client on paper, unless another method is provided for in the transport expedition agreement.

9. The forwarder reviews the order to the freight forwarder within the time limits specified in the freight forwarding agreement and sends it to the client with a note of approval or refusal to approve the freight forwarding services to be provided, indicating the reasons for the refusal.

10. The order to the forwarder is subject to execution from the moment the client receives written confirmation of its approval by the forwarder.

At any stage of the execution of the transport expedition contract, the client has the right to revoke a previously issued order to the forwarder with mandatory reimbursement of actual expenses associated with the execution of the order.

The revocation of an order issued to the forwarder is made by the client in writing.

11. The procedure and conditions for submitting an instruction to the forwarder and the client’s revocation of the issued instruction to the forwarder using fax or electronic communications are determined by the transport expedition agreement.

12. The forwarding receipt is issued by the forwarding agent to the client upon acceptance of the cargo and provides the forwarding agent with the right of ownership of the cargo until the transfer of the cargo to the client or the consignee specified by him upon completion of transportation.

13. If the forwarder accepts the client’s cargo for warehousing, the forwarder issues a warehouse receipt to the client.

14. Unless otherwise established by the transport expedition agreement, when organizing the transportation of cargo, the forwarder, if necessary, carries out:

agreement with carriers on the conditions of transportation and storage of cargo, the time of transshipment of cargo from one type of transport to another and other issues necessary for transportation;

passing customs and other procedures necessary for transportation;

settlements for cargo transportation with carriers both on behalf of the client and on one’s own behalf.

15. At the client’s request, the forwarder provides him with the following information:

full company name and location (for a legal entity), name and place of residence (for an individual entrepreneur);

information on confirmation of compliance of transport and forwarding services with established requirements;

a list of freight forwarding services provided by the freight forwarder and their cost;

information on the form and procedure for payment for transport and forwarding services;

information on tariffs for the transportation of goods by various modes of transport, on the rules and conditions for such transportation;

other information related to the organization and implementation of transportation of specific types of cargo by various modes of transport.

16. The forwarder, in cases provided for by the transport expedition agreement, when accepting cargo from the carrier at the destination, participates in the preparation of relevant documents.

17. When providing freight forwarding services specified in the freight forwarding agreement, the freight forwarder is obliged to follow the client’s instructions.

The forwarder has the right to deviate from the client’s instructions only if this is necessary in the interests of the client or if the forwarder, due to circumstances beyond his control, was unable to first request the client in the manner prescribed by the transport expedition agreement for his consent to such a deviation or receive it within 24 hours from the date notifying the client a response to his request.

18. Dangerous, perishable and other goods requiring special transportation conditions are accepted by the forwarder only if the client provides written information about the conditions of their transportation.

19. The quality of freight forwarding services provided by the freight forwarder must meet the requirements of national standards of the Russian Federation, regulatory legal acts in the field of freight forwarding activities, as well as the terms of the freight forwarding agreement.
